Raceway Ford Cases Home Page
The purpose of this website is to describe the lawsuit, the Classes, the rights and responsibilities of Class Members, and to give you a chance to exclude yourself from the Classes if you wish.
This lawsuit was originally filed as a class action on January 12, 2005, by Robert Loverso. The three Classes identified in the original complaint were the Backdating Class, the Smog Fee Class, and a Tire Fee Class.
Mr. Loverso settled his individual claims with Raceway Ford. The Court then permitted Carl and Deborah Stone, Francisco Salcedo, Anselmo Alaniz, Ernest Myles and Helen Flores, Gloria Mendez and Rosana Martinez, Rene Lopez Romero, Joe and Edelmira Contreras, Jonathan and Martha Ott, Eldridge Johnson, Elisha Mejia, Mable Armstrong, Randal Kidd, Macon and Ozetta Pollard, Suzanna Moreno, and Zenaida Diaz to substitute into the case and represent the Classes. They were granted leave to file the First Amended Complaint in January 2006.
A second lawsuit had been filed by Frederick Gains against Raceway Ford in San Bernardino County Superior Court on October 29, 2004. Mr. Gains settled his individual claims with Raceway Ford, but remained a potential Class Representative for the Backdating Class.
In October 2006, the San Bernardino County Superior Court granted Raceway Ford’s motion to consolidate the two cases. The cases were re-named the Raceway Ford Cases, and assigned to the Riverside County Superior Court.
On March 27, 2008, Judge Mac R. Fisher in the Riverside County Superior Court granted Plaintiffs’ motion to certify the Backdating Class. Judge Fisher certified the Smog Fee and Tire Fee Classes on May 27, 2008. The Tire Fee Class has since been dismissed by the Judge.
In the lawsuit, the Class Representatives allege that Raceway Ford engaged in a series of illegal and deceptive business practices in violation of the Consumers Legal Remedies Act, the Automobile Sales Finance Act, and the Unfair Competition Law. The Court has not yet ruled on the merits of the allegations. A trial date has not yet been set.
Each Class Notice is mailed separately and has its own date by which Class Members must decide to remain in the case or opt out. You may be a member of more than one Class, so please carefully check the information relating to each Notice that you receive.
